Clause I: Organisation

The company AIRBUS S.A.S., having its registered office at 1 rond-point Maurice Bellonte, 31707 Blagnac cedex, is running a large-scale contest entitled "End of the year contest", from 21December 2017 to 5 January 2018 (11:59 p.m., Paris time).

Clause II: Participation

No purchase is necessary for participation in this contest, which is open in all countries to all adults (with the exception of employees and representatives of the organising company, of its partners and subcontractors, as well as of their boards and family members) who have an Internet connection and a valid email address. Only one entry is permitted per person (same name, same address). Participation is on a strictly individual basis and a player cannot under any circumstances play on behalf of other participants. At any time during the contest, participants may be asked to provide proof of their identity or residence. Any contest entry form that is incomplete, illegible, sent after the deadline or in a format other than the one specified will be considered void.

Clause III: Terms and conditions

It is necessary to have a Facebook account in order to enter. A post will appear in the targeted users’ Facebook feed. After clicking on this post, the participant will be redirected to the page https://www.facebook.com/airbus/. The participant must then answer the following question by choosing one of three proposed answers.

The participant must then complete the form with his/her last name, first name, email address and country of residence.

Clause IV: Prizes

The prize for this contest is the following:

  • A 78L Carmona red Rimowa suitcase valued at EUR 549

Clause V: Announcement of winners

In the week following the end of the contest, Maitre Bru, bailiff, or one of her associates, will draw 1 winner and 5 alternates at random from the correct answers. AIRBUS S.A.S. will inform the winner of the result by post and by email. If the winner does not respond within 8 days after confirmation that he/she has won, he/she will be disqualified and his/her prize will be forfeited as defined in Article X and given to the first of the designated alternates. The prize cannot be paid in cash, or as any other consideration of any kind, and is not transferable. However, in the event of force majeure, AIRBUS S.A.S. reserves the right to replace the announced prize with a prize of an equivalent value. Participants designate the address indicated on the contest Form as their domicile for delivery of the prize. The winner authorises any verifications with regard to his/her identity and residence (postal and/or Internet address). False addresses or identifying information will result in disqualification of the winner and all of his/her entries.

Clause VI: Legal deposit

The rules are filed via www.reglement.net, at the SCP Bornecque Winandy - Bru Nifosi, bailiffs in partnership, 15, Passage du Marquis de la Londe - 78000 - Versailles. The rules may be modified by the organiser at any time in the form of a rider, in keeping with the stated conditions, and published by online announcement on the site. Before its publication, the rider will be registered with the SCP bailiffs partnership with whom the rules are filed. The rider will come into force when it goes online and any participant will be considered to have accepted it simply by participating in the Contest, effective as of the date the modification comes into force. Any participant who refuses the modification(s) must cease participation in the Contest. The rules will be sent at no charge to any person who makes a written request by post prior to the contest end date, at the following address:

The complete rules can also be consulted online on the contest website. Upon request, postal fees necessary for obtaining the rules will be reimbursed based on the slow “letter” rate in effect.

Clause VII: Reimbursement of game costs

Where expenses are incurred, participants may obtain repayment of costs relating to their estimated playing time from a fixed telephone at France Telecom rate, on the basis of a three-minute connection at reduced rate of 0.15 Euros. Applications for reimbursement are to be sent by mail to the game address (see Clause VI) accompanied by a bank account details and a detailed invoice in the name of the participant, showing the date and time of connection, no later than 30 days after the date that the game closes, the postmark on the envelope being the proof of posting. Costs incurred by the participant for the stamp necessary for this application will be repaid upon request on the basis of the slow rate letter in force. One single application for repayment per participant registered to play and per envelope (same name, same address) will be acceptable. Incomplete applications will not be considered.

Given current offers of service and technology, some Internet providers offer free or fixed connection to internet users, it is expressly agreed that if the access to the site is on a free or fixed basis (as with connection by cable, ADSL or special link) then the participant will not qualify for reimbursement insofar as the subscription to the provider is entered into, in this case, by the internet user for the use of the Internet in general and the fact of the participant connecting to the site and participating in the game does not result any additional cost or disbursement to them.

Clause VIII: Reimbursement of contest fees

Upon request, any participant may obtain reimbursement of fees relating to estimated playing time on a land line, using the France Telecom rate, based on a 3-minute connection at the reduced rate, i.e., EUR 0.15. The reimbursement request, accompanied by banking details and a detailed invoice in the participant's name indicating the date and time of the connection, must be sent by post to the contest address (Article VI) no later than 30 days after the contest end date, as attested by the postmark. Upon written request, the costs incurred by the participant for the stamp needed to make this reimbursement request will be reimbursed based on the regular "letter" rate in force. Only one reimbursement request per participant registered in the contest and per envelope (same name, same address). Incomplete requests will not be considered.
Given that in the current state of service offers and technology, certain Internet providers offer their clients free or all-inclusive Internet service, it is expressly agreed that there will be no reimbursement for site access made on a free or all-inclusive basis (such as cable connection, ADSL or specialised link), because in this case, the user subscribes to the Internet provider’s service in order to use the Internet in general, and the participant is not required to pay any additional fees or expenses in order to connect to the site and participate in the contest.

Article IX: Disputes and liability

Participation in this contest implies the unconditional acceptance of the rules in their entirety. If one or more provisions of these General Rules are declared void or inapplicable, the other clauses will retain their full force and scope. In the event the version of the rules filed with the bailiff's office differs from the version of the rules accessible online, only the version filed with the Bailiff will prevail. Any inaccurate or misleading statement or fraud will result in the disqualification of the participant. AIRBUS S.A.S. will definitively settle any dispute related to the contest and its rules in agreement with the SCP Bornecque Winandy - Bru Nifosi, bailiffs partnership. No response will be given to any telephone request or written request concerning the interpretation or application of these rules, the mechanisms or conditions of the contest, or the list of winners. In the event of dispute, only a registered letter with return receipt requested, sent within one month after the announcement of the results, will be accepted. AIRBUS S.A.S. reserves the right, if the circumstances require, to shorten, prolong, modify or cancel this contest in keeping with Article VI. It cannot be held liable for doing so. AIRBUS S.A.S. may cancel or suspend all or part of the contest if it appears that fraud has been committed in any form whatsoever, in particular by electronic means, in the context of participation in the contest. In this scenario, it reserves the right not to award the prize to the fraud perpetrator and/or to bring proceedings against the perpetrators in the competent courts.
This contest is hosted on the Facebook website. Each participant must comply with the conditions of use of the Facebook website. The Participant further acknowledges that he/she is aware of the general conditions of use and the confidentiality policy of the Facebook website, which can be consulted directly on the Facebook website. The registered office of Facebook is located at: 1601 S. California Ave., Palo Alto, CA 94304. AIRBUS S.A.S. assumes no liability as to the content and use of the Facebook site. Likewise, the participant releases Facebook from any liability concerning the organisation of this contest, and declares that he/she is aware that Facebook is neither the administrator nor the sponsor of the contest. In this regard, the participant may be asked to provide a written release at any time during the contest. The personal information collected in the Contest is sent to AIRBUS S.A.S.

Clause X: Personal information

The Organiser collects the personal information indicated on the online registration form (first and last names, email address and country of residence) in order to manage, administer, promote the contest and distribute the prize (in order to correctly register entries, determine the winner, award and deliver the prize).
All information requested in the registration form is mandatory in order to participate in the CONTEST. The participant may object for legitimate reasons to the collection of his/her personal information. In this case, the Organiser may not consider his/her entry.
In our processes, we pay special attention to the important issue of protection of privacy in the processing of your personal information. For this reason, the Organiser protects and ensures the safety of the participants’ personal information. In this context, and pursuant to the Group's policy on protection of personal information (CDS-118), Airbus takes all appropriate precautions in compliance with European regulation on protection of personal information, which guarantees an adequate level of protection for supervision of international data transfers by means of restrictive rules (the BCR or Binding Corporate Rules) validated by the European Union's national data protection authorities and by the standard contractual clauses adopted by the European Commission.
This information is intended for the Organiser and may be sent to its technical staff and to any service provider handling delivery of the prize.
By clicking "Send,” the participant agrees to send his/her information to Airbus, which agrees to use it in accordance with its confidentiality policy and with the aforementioned conditions. Facebook will also use it in accordance with its data policy, in particular concerning autofill forms for advertisements. The participant agrees to receive marketing emails, and the Organiser and the related companies which use the Airbus brand may periodically contact the Participant by email to present information, offers, products and services that may be of interest to him/her. For direct marketing purposes, the Participants’ personal information (first and last names, email address) will be collected and shared with other organisations which provide data matching, trend analysis and marketing services to the Organiser. The Organiser may also use target marketing, data matching, online audience and market segmentation to improve the relevancy of the advertising.
Participants may request that their names be removed from the Organiser’s files. Participants who ask to have their names erased from the files prior to the end of the contest will be assumed to have withdrawn their participation.
Participants also have the right to access, correct and update their personal information during processing.
Participants may also object, free of charge, to the processing of their personal information for marketing purposes.
To do this, they must contact Airbus by post at the following address: Airbus S.A.S., Responsable de la protection des données, BP B80-W14, W192, 2 rond-point Emile Dewoitine, BP 90112, 31703 Blagnac cedex, or by email to dataprotection@airbus.com, attaching a document showing proof of their identity and indicating the specific right they intend to exercise.

Clause XI: Awarding Prizes

By accepting his/her prize, the winner authorises AIRBUS S.A.S. to use his/her last name, first name, postal or email address in any promotional event related to this contest, without consideration other than the prize won, during a maximum period of 2 years. AIRBUS S.A.S. will not be held liable for delays, losses, damage, or illegibility of stamps due to actions of the postal services, that occur at the time of prize delivery. If the prize is not claimed through the postal services, or it if is returned within 30 calendar days after sending, it will be forfeited by the participant and will be the property of AIRBUS S.A.S. The winner waives the right to claim any compensation from the organising company due to harm caused by the acceptance and/or use of the prize.

Article XII: Agreement on proof

Except in case of manifest errors, it is agreed that information resulting from the AIRBUS S.A.S. contest systems have evidentiary value in any dispute as to the connection elements and the computer processing of said information in relation to the contest.

Article XIII: Assignment of jurisdiction

Participants are subject to French regulation applicable to games and competitions. Any dispute not settled out of court will be subject to the competent courts designated according to the Code of Civil Procedure.

Clause XIV: Data protection

Personally identifiable information collected as part of this contest is processed in accordance with the Data Protection Act n° 78-17 of 6 January 1978. Pursuant to Article 27 of this act, all contest participants have the right to access or correct their information. Any request to access, correct or make an objection must be sent to AIRBUS S.A.S.

Article XV: Literary and artistic property rights

In accordance with the laws governing literary and artistic property rights, the reproduction and representation of all or part of the elements comprising this contest are strictly prohibited. The brand names mentioned are registered trademarks of their respective owners.
